Welcome to our Terms and Conditions. On this page, we aim to explain all of the legal information that you need to be aware of in simple terms. However, if there is something that you are not clear on, then please feel free to get in touch.

The use of “Baby, are you nuts?” carries with it risks that we cannot entirely eliminate. As a result of the nature of “Baby, are you nuts?” and the allergens it contains, these include the risk of adverse health effects for any infant, child or adult taking “Baby, are you nuts?”, which in the worst cases could lead to a severe allergic reaction or even death. 

Before using “Baby, are you nuts?”, you must ensure you thoroughly read and understand all safety warnings and instructions displayed on or provided with “Baby, are you nuts?” (which can be found in the box on the calendar or online at www.babyareyounuts.co.uk/howtouse, and you understand the risks associated with using “Baby, are you nuts?”. If you have any questions or concerns about the suitability of “Baby, are you nuts?” for you or your child, you should obtain advice from a qualified medical professional before using “Baby, are you nuts?”. 

If you notice any adverse health effects in any infant, child or adult taking “Baby, are you nuts?”, you should stop using “Baby, are you nuts?” immediately and contact an appropriate medical professional immediately. 

“Baby, are you nuts?” should not be used by any person who already has, or may have, an allergy to Peanuts,Cashew Nut, Hazelnut, Walnut, Brail Nut, Almond, Sesame Seed or Soya or has increased risk factors associated with an allergy to Peanuts,Cashew Nut, Hazelnut, Walnut, Brail Nut, Almond, Sesame Seed or Soya, any of the allergens provided as part of “Baby, are you nuts?” without first obtaining advice from a qualified medical professional. 

RELV Limited will not be responsible for any consequences or liability arising from your failure to follow the safety warnings and instructions provided with “Baby, are you nuts ?” or as a result of you not obtaining suitable advice from a qualified medical professional. However, nothing in this notice excludes or in any way limits RELV Limited’s liability for death or personal injury arising from any negligence, act or omission on the part of RELV Limited or for any other liability that cannot be limited or excluded by law.

Terms of Sale 

We would recommend that you read these terms of sale carefully before ordering any products from our site. These terms of sale tell you who we are, how we will provide products to you, what we expect you to do, what to do if there is a problem and other important information.

By placing an order on our site, you agree to be bound by these Terms and Conditions.

The Product

Just in case you missed it, all of our beautiful packaging products are recyclable from the postage wrap to the product box and single serve sticks, where need wash and recycle. If the food packaging (not the outer box) is damaged in anyway, pieced, teared or broken DO NOT CONSUME and please report to hey@babyareyounuts.co.uk 

Pre-Orders

We may, from time to time, sell items that are not yet physically in our warehouse. We call this a pre-order. These items are clearly identified on our website and both on the product page, and within the checkout process, an indicative date of delivery may be given.

PLEASE NOTE Quite often this can be subject to change due to reasons beyond our control, for which we assume no liability. However we will endeavour to inform you of any delays to this date by email.

If your order consists of a pre-ordered item and an item that is currently in stock, we will look to deliver your entire order together.

Prices

We aim to always offer our customers the best possible prices. All of our prices exclude delivery charge unless otherwise stated.

  • Promotions & Discounts: From time to time, we may offer promotional prices or discount products within a sale. Any such offers will apply to selected products and will be subject to availability.
  • Discount Codes: From time to time, we may offer discount codes on selected products or basket values. These discount codes will only be available for a limited amount of time, and when issued, we will clearly display when they expire. If you are returning an item where a discount code has been applied, then your refund will be for the full amount minus the discount applied from the discount code. We reserve the right to refuse fulfilment of orders if we notice with our reasonable opinion unfair use of promotions or discount codes.
  • Product Bundles: From time to time, we may offer you the opportunity to buy a bundle. A bundle is a defined group of products that we specify and make available for you to buy at a discounted rate. If you were to buy a bundle, and then decide to return one of the items within the bundle, we would only look to refund you the discounted value of the product rather than the full advertised price.

Prices on the website may be changed at any time without further notice. We reserve the right to change our product's prices at any time without further notice.

We are unable to offer a price adjustment on items originally purchased in a sale, promotion, or with any discount codes. Once an item has been purchased at a discounted sale price, no price adjustment will be offered should the item be further marked down.

Payment

Payment for all orders must be made by credit or debit card either directly via our website. We also recently launched Klarna as a way of offering our customers the opportunity to buy from us without having to pay upfront.

Payments using Klarna

Please note that if you choose to use Klarna to pay for your purchase, that this agreement is between you and Klarna. If you have any trouble placing an order with Klarna, it could be due to one of the following reasons:

  • Klarna payments are subject to your financial circumstances. Klarna may have rejected your application to Pay later or Pay later in 3. We would recommend choosing another type or payment or placing an order for a smaller amount.
  • You may have outstanding payments on previous Klarna purchases.
  • You may have missed a required field at the checkout, such as filling in your date of birth.

Please note that Klarna is an independent payment company and we have no influence over whether your payment with Klarna is accepted or not. If you have any trouble with your order, please contact Klarna Customer Service.

Orders & Shipping

How long does delivery take?

Once dispatched your order will be delivered within 1-3 business days with standard shipping tracked Royal Mail. You'll receive a shipping confirmation email and will be able to track the order to your door!

Our team does not work on weekends or bank holidays, so orders placed during this time will be processed as soon as we are back.

Please note that delays with Royal Mail e.g. strike action, will likely cause delays with orders arriving - which is sadly outside of our control.

We currently do not shipped outside of UK mainland.

Cancellations and Refunds

We pride ourselves on offering products that are fit for purpose, but just to be clear, it's also our legal responsibility to make sure that this is the case. The Consumer Rights Act 2015 states that, as a customer, you have a legal right to either a refund,  or replacement for products that are faulty, once the fault has been reported. 

Gift cards or any other form of electronic voucher payment cannot be returned or exchanged for cash. Returned items which are not in new or unused condition will not be fully credited to your account unless they are faulty. This does not affect your statutory rights.

You want to cancel a Pre-Order item

We fully understand that sometimes you change your mind and you need to cancel your order. At Baby, are you nuts?  If you change your mind about the pre-order that you have placed on our website, then please contact us hey@babyareyounuts.co.uk as soon as possible requesting to cancel your order.

As long as your items have not been dispatched we will cancel your order and refunded you with in 28 working days.

Leaving a Review & Customer Reviews

Once your item has been despatched, we will automatically send you an email approximately ten days after you receive your item so that you can provide us with some feedback. These reviews are then moderated and pushed up onto our website.

Please note that all customer reviews are the opinions of our customers and do not form any part of the specifications or description of the product. We will not be held liable if any information within a customer review proves to be inaccurate.

We reserve the right to use any images provided as part of a customer review in our promotional or marketing campaigns.

Baby, are you nuts? is a trading name of RELV limited company (15008771) registered in England whose registered office is at Oaklands, Hemyock, Cullompton, Devon, EX15 3PF

This contract is between you and us. No other person shall have any rights to enforce any of its terms, whether under the contracts (Rights of Third Parties) Act 1999 or otherwise.

Baby, are you nuts? reserves the right to change these Terms & Conditions at any time.
